CONDITIONS OF PARTICIPATION Competitions for the 125th anniversary of PALLMANN

Scope of application

These conditions of participation apply to the competitions organised by PALLMANN GmbH on the occasion of the 125th anniversary of PALLMANN. By participating in the competition, each participant recognises these conditions of participation.

Organiser

The competitions are organised by PALLMANN GmbH, Im Kreuz 6, 97076 Würzburg.

Eligibility to participate

Persons who have reached the age of 18 are eligible to participate. Employees of the Uzin Utz Group are not eligible to participate. Participation is free of charge and in no way dependent on the purchase of goods or the utilisation of a service.

Prize

Each monthly winner will receive a prize, which will be announced on the respective homepage for the monthly competition registration. The prizes are non-transferable and cannot be paid out in cash. Claims against the organiser for material defects and defects of title of a prize are excluded.

Procedure of the competitions

The competitions on the occasion of the 125th anniversary of PALLMANN will take place monthly between 01 January 2025 (00:01, GMT+2) and 31 December 2025 (23:59, GMT+2). One monthly winner will be chosen each calendar month between January 2025 and December 2025.

Participation is only possible within the respective monthly participation period, in each case from the first day of the calendar month (00:01, GMT+2) to the last day of the respective calendar month (23:59, GMT+2). Responses received after the closing date will not be considered. Only one entry per person and per month is possible.

Determination, Notification and Handover of winnings

At the end of the specified participation period, the winner will be selected from all participants by drawing lots within one week. Only participants who fulfil the requirements described in these conditions of participation will be entered into the draw. Legal recourse is excluded.

The winners will also receive a prize notification by e-mail with the request to provide the organiser with their first name, surname and address for the purpose of sending the prize. If the participant has not provided their contact details within 7 days of notification, or has provided incomplete details, the prize will be forfeited without substitution. The organiser reserves the right to select another participant at random and notify them accordingly.

The prize will be handed over to the monthly winners in person via the Organiser's sales force or by post to the address provided by the participant, at the Organiser's discretion. The participant bears the risk of the shipment.

Liability

The Organiser shall be liable for damages in accordance with the statutory provisions. However, in the event of a simple negligent breach of essential obligations, the organiser's liability shall be limited to compensation for typical, foreseeable damages; in the event of a simple negligent breach of non-essential obligations, the organiser's liability shall be excluded. The above limitations of liability shall not apply in the event of loss of life, physical injury or damage to health.

Violation of the conditions of participation

In the event of a breach of these conditions of participation or the justified suspicion of a breach by a participant, the organiser is entitled to exclude the respective participant.

Changes to these conditions of participation and premature termination of the competition

The organiser reserves the right to unilaterally amend these conditions of participation for good cause or to terminate the competition prematurely. This applies in particular if proper implementation cannot be guaranteed for technical or legal reasons, in the event of mass abuse of the promotion or subsequent legal inadmissibility due to a change in the legal situation.

Data protection

Personal data is only collected in connection with competitions to the extent absolutely necessary for the organisation of the competitions (drawing of the winners, publication of the winners' names; checking the conditions of participation (multiple participation)). The following data is stored: first and last name, address, e-mail, telephone number and company.

The legal basis for the processing of the data is Art. 6 para. I lit. b.) GDPR. The organiser will only store the participants' personal data for as long as it is required to run the competition, after which the data will be deleted. Under no circumstances will the organiser pass on or sell personal data to third parties. The participant hereby expressly declares his/her consent to the storage and use of the personal data provided by him/her for the above-mentioned purpose.

As data subjects, participants are entitled to the rights specified in Art. 15 - 21 GDPR, in particular the right to erasure, rectification, restriction of processing and the right to lodge a complaint with the competent supervisory authority. An informal message by email to: datenschutz@pallmann.net is sufficient for erasure. If the request to delete data is made before the end of the competition, further participation in the competition is no longer possible.

Final provisions

a) Legal recourse is excluded.

b) The law of the Federal Republic of Germany shall apply.

c) Where permissible, the place of jurisdiction for all disputes shall be Ulm.

d) Should individual provisions of these conditions of participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.
